  1.                     END USER AGREEMENT

  3. BY DOWNLOADING THIS SOFTWARE, YOU AGREE TO ABIDE BY THE TERMS OF
  4.                                 THIS END USER AGREEMENT
  5.     Subject to the terms and conditions provided below, Absolute
  6. Protect, located at 2938 Dundas W #694 Toronto, Ontario, Canada M6J 4E7
  7. hereby grants the following license to you for the AbsoluteProtect
  8. Computer Theft Recovery Software(the "Software").
  9.  
  10. 1. Grant of License. Absolute Protect grants to you a non-exclusive, 
  11.  non-transferable license to install and use the Software on your computer.  
  12.  Such license grant is conditioned upon the following limitations: 
  13.  (i) copies of the Software may be made for backup and archival purposes only; 
  14.  (ii) you do not reverse engineer, decompile or disassemble the Software; and 
  15.  (iii) you do not use the Software for purposes other than as authorized in 
  16.  this end user agreement or knowingly permit anyone else to do so;

  18. 2. Term of License.  This license is effective until terminated.  You may
  19.  terminate it any time by deleting the Software and all accompanying
  20.  documentation and copies thereof from your computer. You may transfer the
  21.  Software provided that (i) the transferee fully accepts the terms and
  22.  conditions of this Agreement and (ii) all complete or partial copies of the
  23.  Software, including copies on data storage devices, are also transferred or
  24.  destroyed.  This license will terminate automatically if you fail to
  25.  comply with any term or condition of this Agreement
  26.  
  27. 3. Intellectual Property.  All rights to the Software and all copyrights
  28.  patents, trademarks, service marks, or other proprietary rights relating
  29.  thereto are and shall remain with Absolute Protect. You acknowledge that 
  30.  no rights, title or interest in these items is granted under this Agreement
  31.  Authorized copies of the Software shall contain all copyright notices or
  32.  proprietary legends that are contained or embedded in the Software
  33.  You must no change Software.

  35. 4. Limited Warranty. THE SOFTWARE IS PROVIDED "AS IS" AND WITHOUT
  36.  EXPRESS OR IMPLIED WARRANTIES OF ANY KIND, INCLUDING BUT NOT
  37.  LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS
  38.  FOR A PARTICULAR PURPOSE, AND ALL SUCH OTHER WARRANTIES ARE
  39.  EXPRESSLY DISCLAIMED
  40.  
  41. 5. 30-Day Money Back Guarantee
  42.  You may return a product for credit, exchange, or refund (less shipping 
  43.  costs) within 30 days from date of purchase. Send us email at 
  44.  absolute@absolute-protect.com to obtain a Return Authorization (RA) number 
  45.  before returning a product in order to prevent it from becoming lost.

  47. 6. Limitation of Liability.  IN NO EVENT WILL Absolute Protect BE LIABLE 
  48.  TO YOU OR ANY OTHER PARTY FOR ANY LOST PROFITS, LOST SAVINGS OR OTHER
  49.  INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES
  50.  EVEN IF Absolute Protect HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH
  51.  DAMAGES.  IN NO EVENT SHALL Absolute Protect's LIABILITY EXCEED THE FEE
  52.  PAID FOR THE SOFTWARE

  54. 7. General. If any provision or part of any provision of this Agreement
  55.  shall be held invalid or unenforceable, such part shall be ineffective
  56.  without in any way affecting the remaining parts of such provision or the
  57.  remaining provisions of this Agreement
  58.  
  59. 8. Export Compliance. You agree to comply with applicable Canada export
  60.  laws and regulations in connection with the acquisition, use and transfer
  61.  of the Software
  62.  
  63. 9. Government End Users.  The Software is subject to Restricted Rights
  64.  and is subject to the restrictions set forth in the applicable Federal
  65.  Acquisitions Regulations
  66.  
  67. CERTAIN JURISDICTIONS PROVIDE FOR GREATER RIGHTS THAN WHAT
  68. IS PROVIDED IN THIS AGREEMENT.  YOUR RIGHTS WITH RESPECT
  69. TO THIS AGREEMENT MAY VARY DEPENDING ON YOUR JURISDICTION
  70. MODIFICATION OF THESE TERMS AND CONDITIONS
